After the Township Assessor's and County Auditor's department calculated New Albany's assessed property value and submitted it to the Department of Local Government Finance, the state ordered the city to reduce the budget it approved last fall, a document based in part on projections of net worth.
City Controller Kay Garry stated: New Albany has operated this year on a $16,414,975 general fund. The state ordered a $589,095 cut at 3.6 percent to $15,825,880.

Why won't Controller Garry suggest that the $589,095 cuts on the general fund be made rather than dipping into the Rainy Day Fund?
We have to do everything we can to hold down our property taxes. When those new higher tax bills arrive in the mail, there will be alot of angry taxpayers.
Watch your mailbox! Our tax bills may be mailed out soon.
Garry's first option was to use the Rainy-Day Fund and the River Boat Fund to cover cost. The 2nd option would be to make no cuts to a budget Garry called "bare-bones" and would use solely Rainy Day Fund money to plug the general fund gap.

Freedom of Speech would like to say: Our current administration has known for over 3 1/2 years, extreme growth in healthcare costs and pension obligations combined with contractually mandated salary increases are forcing deep cuts in other parts of the budget. The growth in healthcare, pensions, contractual obligations and fuel continues to exceed the budget growth allowed by state law and, if not dealt with, will soon force cuts in vital services like police and fire protection (which represent 82.7% of our budget).
The council now can decide to further cut or add to the budget but it is our hope they will provide us taxpayers with much needed relief.
The miscellaneous spending "is unfortunately symbolic of the attitude of some council members, that they really have no intention of changing the way they operate, and have no appreciation for the crisis the city is under, and are not responding to it."
"They don't get it. They simply don't understand what it means to be frugal."
A successful group of people are ones who can lay a firm foundation with the bricks that others throw at him and her.

IS NEW ALBANY NEXT?
We are encouraged by Governor Daniel's calling last week for the Creation of the Commission on Local Government Reform to explore and analyze ways in which local government can operate more efficiently and effectively. We also applaud the Governor's order for reassessment in Marion County and are very much supportive of his willingness to examine ordering reassessments in counties across the state as warranted.
Will New Albany be next?
We urge our Governor to call for a special session of the Indiana General Assembly to provide immediate property tax relief for all Hoosiers who are suffering with massive tax bills statewide. In addition, we recommend the Commission look for long-term solutions to Indiana's complex property tax system.

ANOTHER UPDATE: OHIO RIVER GREENWAY MOVES FORWARD
Aiming to connect the Indiana riverfronts of Jeffersonville, Clarksville and New Albany along a continuous recreational trail system, the Ohio River Greenway will span nearly seven miles. The many benefits of this trail combine public use for pedestrians, bicycle enthusiasts and outdoor recreation users along the banks of the Ohio River.
"We have made exciting progress since last September, and nearly $5 million in construction is now underway in New Albany and Jeffersonville," Valla Ann Bolovschak, who is Governor Mitch Daniels' appointee to the Ohio River Greenway Commission. Valla Ann states that this initiative by Governor Daniels will begin to unite our state's disconnected routes and put every Hoosier within 15 minutes of a trail."
This week Congressman Baron Hill toured the Greenway project with Valla Ann and other commission members. Baron stated that this is such a vitally important project for this region,"
Congressman Hill states "He is committed to obtaining the $2,100,000 in federal funding which was requested earlier this year."
The Greenway's eastern most beginning is in the City of Jeffersonville next to Jeffboat. Valla Ann says although Jeffersonville's riverfront is the most developed of the three communities that make up the Greenway, the addition of improved access will allow pedestrians and bicyclists recreational opportunities that do not exist now.
"The Greenway plan features a multi use path close to the river, and at some points, at the river's edge."
This will allow for public access and provide renovated dock space.
Valla Ann also says the existing Terraced Lawn at the foot of Spring Street will be improved with a pathway and additional lighting. The path will be connected to a landing at the base of the Big Four Bridge and will provide direct access to Louisville.
Bolovschak says, the New Albany section of the Greenway Corridor will begin at the City's eastern edge at Silver Creek and the Kentuckian River Trail-the K and I Bridge and Big Four Bridge loop-ends in New Albany and will allow pedestrians and cyclists access to the Louisville River walk.

Whenever an item or other asset owned by the political subdivision is entrusted to an officer or employee, to be used at times outside the normal work time for business purposes, such as a cellular phone, or vehicle, a log should be maintained which clearly shows the business use.

Freedom of Speech would like to know what part of this law do the city employees not understand. The 2006 State Audit states that records for use of city equipment should be kept.
The city employees are in violation of state laws if they do not keep records on use of city equipment.

NEW BOARD PRESIDENT
Monday evening July 9th , the New Albany Floyd County School Board unanimously named Mrs. Rebecca Gardenour it's new president. With fined leadership skills intact, Gardenour moved upto becoming the NAFC School Board Trustee President.
Mrs. Gardenour, whose term runs from July 1, 2004 to June 30, 2008, served as Vice-President for the last year.
Gardenour also confirmed the nomination and selection of Neal Smith as new Vice President, and Trisha Badger Byrd as secretary. Mr. Smith served as the secretary for the past year and Trisha Badger Byrd served as a member.
School Board President Gardenour stated: Both Smith and Byrd have been very instrumental to policy and proceedings over the past year.
Mrs. Gardenour, who frequently works with children in Floyd County, has a zest for education and a passion for children, children are her top priority! In fact, she was recently sworn in by New Albany's Judge Terry Cody as a "child advocate." She has proven to be a fervent supporter of public education, teachers and all facets of the NAFC School Corporation.

WHO POLICES THE POLICE DEPARTMENT?
What has happened to New Albany's Police Motto:
"To Serve and Protect?
Is the New Albany Police Chief using a recent tragedy to get what he wants?
A sad day in New Albany!
How could the New Albany Police Chief use a recent killing of a Floyd County Deputy Sheriff as an excuse to get more perks for his Police Department?
Our hearts and sympathy go out to the families of the Floyd County Sheriff's Department. We are sad that our New Albany Police Department is using that tragedy to get what they want.
In a recent TV news statement, the New Albany Police Chief Harl said: he was now allowing his police staff to use city-owned cars to go anywhere. He felt this improved safety in New Albany.

It could improve safety IF the police cars were in New Albany.
Question: How can a New Albany police officer protect New Albany citizens if he is in Salem, Indiana, or-miles out of town in other counties?
Ask yourself this question : How much faster could have the NAPD had been able to reach Officer White and Officer Denzinger if our officers would have been patrolling our City of New Albany instead of being scattered through out the various counties?
We are paying for there salaries and there vehicles. Again it is documented that a big percentage of the city budget goes to the New Albany Police Department.
Should taxpayers not get the service that we pay for...Chief Harl?
What will citizens do if we have a train derailment on 15th street and our city is blocked from both directions?
Freedom of Speech feels the time is right for a thorough and comprehensive review of the take home car policy. It's time to take another look into how the police department polices itself."
It seems to us that if a department does not like our council's laws, they decide to say the hell with it. And...do what they want.

So--It is time to bring the New Albany police and their cars back home to New Albany. We could be much safer if the New Albany police cars were in New Albany... Do you agree taxpayers?

11. No officer issued a 24-hour vehicle will drive his vehicle on days he has been suspended or is off due to sickness.
a. A day in regards to suspension is considered from 12 midnight to 12 midnight the date of suspension.
b. A day in regards to sickness is considered from 12 midnight to 12 midnight on dates of sickness when the Officers is scheduled off.
c. A day in regards to sickness is considered the 16 hours following the last scheduled tour of duty during the date an Officer has taken off sick.
Note: If you're to sick to work, you're to sick to drive a 24-hour vehicle the same day!

I. PURPOSE
The purpose of the 24 Hr Patrol Program is to convey a sense of Police presence in our community. The best deterrent for the prevention of crime is a highly visible & mobilized force.
II. POLICY
The Officers using this program will present a professional appearance and attitude while both on & off duty.
Officers shall not use the vehicles in any manner to cause embarrassment or discredit to the Police Department.
To insure this the following rules & procedures must be followed.
The use of a 24-Hr vehicle is to be considered a privilege, not an employee benefit, and shall be subject to revocation at the discretion of the Chief of Police.
III. PROCEDURES
A. Department vehicle Operation
1. Vehicles will only be driven by the officer assigned. Any other temporary operator must have authority from the Chief of Police, Assistant Chief, or Major.
2. When driving the vehicle off-duty the police radio will be turned on, carry a firearm (authorized & qualified), and carry Police ID at all times.
3. No one shall operate an assigned Police vehicle outside the confinement of city limits of New Albany, EXCEPT:
a. If the Officer lives in Floyd County they may drive their assigned unit to and from work.
b. If the Officer lives in Floyd County they may drive to and from home when coming to the city on personal business.
c. In the performance of their duty or when authorized by the Commanding Officer.
4. Police vehicles may be used for private off-duty use following the guidelines below.
. No passengers be transported other than a parent, spouse child, or step-child, brother and sister, or a person being transported by reason of the officer acting in the line of duty and in the scope of his employment (for example, transporting an arrested person).
b. Officers are responsible for the conduct of any passengers
c. Officers are prohibited from making Emergency (Code 3) while the vehicle is occupied by passengers, except in the interest of protecting life such as taking an injured person to the hospital.
5. Officers operating a Police vehicle will obey all traffic laws and take extra care not to draw attention or discredit the department.
6. No officer while on-duty shall have anyone ride without expressed permission from the Chief of Police, Assistant Chief, Major, or Commanding Officer and a WAIVER SIGNED.
7. Whenever an Officer is involved in an accident off-duty he will immediately inform the radio dispatcher of the situation and have an accident report made. The report will be made by the Commanding Officer on duty at the time.
8. Police vehicles will not be used in any other type of EMPLOYMENT or DRIVEN TO & FROM SUCH EMPLOYMENT without the consent of the Chief of Police.
* So Chief Harl you are telling us taxpayers we have to pay the gas, insurance, tires and maintenance so our Police Officers can work a second job?
9. Except in the performance of duty, the vehicle will not be parked or left unattended on any parking lot in front of or NEAR TAVERNS or LIQUOR STORES or any other place which may cause discredit to the department.
10. No alcoholic beverages will be transported in the vehicle except in the performance of duty. Officers will not drive a vehicle when they have been drinking alcoholic beverages or they expect to do so.
B. Maintenance and care of Department Vehicles:
1. The officer assigned a vehicle will be responsible to see that the proper maintenance is maintained.
2. Schedule any work to be done with the city garage. No one without authority of the Chief of Police, Assistant Chief, or Major Will be allowed to work on police vehicles.
3. Officers will keep maintenance records and turn in a monthly report to the Major.
4. No equipment will be installed or carried in the vehicle without authority of the Chief of Police, Assistant Chief, or Major.
5. No animals will be transported in the vehicle unless the unit is designated as an official K-9 unit.
6. The officer assigned the vehicle will be responsible to keep it clean inside & out as often as possible.
C. Personal Appearance
1. Full Uniform
a. At no time will only part of the uniform be worn. When an officer operates his vehicle off-duty in uniform, he/she shall be in full uniform, of the season, the same as if he was on-duty.
2. Civilian Dress
a. When operating a police vehicle off-duty officers civilian dress will be neat & clean. Sport clothes will be allowed, but the main trunk of the body shall be clothed.
D. Police Activities
1. When an occasion arises that an officer must become involved in a police activity off-duty, he shall notify the radio dispatcher immediately, giving his unit number, location, and all pertinent information, and take whatever action necessary to resolve the situation.
2. When an occasion arises that an Officer must become involved in a police activity off-duty and has his family or other passengers in the vehicle he will take whatever steps necessary to insure their full and complete safety.
3. The officers involved in this program will make necessary reports of incidents that he handles off-duty. In cases of a serious nature standby until the on-duty officer arrives and he will be responsible to make the reports.
4. A LOG BOOK will be keep in each unit and a monthly activity report turned into the Major.

Well first of all, 20 years ago the price of gas was $0.95- $0.97 per gallon and today the average price of gas is about $2.84 per gallon. The use of a 24 Hr vehicle should be a privilege, not an employee benefit.

In a recent TV news statement, the New Albany Police Chief Harl said: he was now allowing his police staff to use city-owned cars to go anywhere. He felt this improved safety in New Albany.

Question: How can a New Albany police officer protect New Albany citizens if he is in Salem, Indiana, or-miles out of town in other counties?
Ask yourself this question : How much faster could have the NAPD had been able to reach Officer White and Officer Denzinger if our officers would have been patrolling our City of New Albany instead of being scattered through out the various counties?
We are paying for there salaries and there vehicles. Again it is documented that a big percentage of the city budget goes to the New Albany Police Department.
Should taxpayers not get the service that we pay for...Chief Harl?
What will citizens do if we have a train derailment on 15th street and our city is blocked from both directions?

a. A day in regards to suspension is considered from 12 midnight to 12 midnight the date of suspension.

c. A day in regards to sickness is considered the 16 hours following the last scheduled tour of duty during the date an Officer has taken off sick.

I. PURPOSE
The purpose of the 24 Hr Patrol Program is to convey a sense of Police presence in our community. The best deterrent for the prevention of crime is a highly visible & mobilized force.
II. POLICY
The Officers using this program will present a professional appearance and attitude while both on & off duty.
Officers shall not use the vehicles in any manner to cause embarrassment or discredit to the Police Department.
To insure this the following rules & procedures must be followed.
The use of a 24-Hr vehicle is to be considered a privilege, not an employee benefit, and shall be subject to revocation at the discretion of the Chief of Police.
III. PROCEDURES
A. Department vehicle Operation
1. Vehicles will only be driven by the officer assigned. Any other temporary operator must have authority from the Chief of Police, Assistant Chief, or Major.
2. When driving the vehicle off-duty the police radio will be turned on, carry a firearm (authorized & qualified), and carry Police ID at all times.
3. No one shall operate an assigned Police vehicle outside the confinement of city limits of New Albany, EXCEPT:
a. If the Officer lives in Floyd County they may drive their assigned unit to and from work.
b. If the Officer lives in Floyd County they may drive to and from home when coming to the city on personal business.
c. In the performance of their duty or when authorized by the Commanding Officer.
4. Police vehicles may be used for private off-duty use following the guidelines below.
. No passengers be transported other than a parent, spouse child, or step-child, brother and sister, or a person being transported by reason of the officer acting in the line of duty and in the scope of his employment (for example, transporting an arrested person).
b. Officers are responsible for the conduct of any passengers
c. Officers are prohibited from making Emergency (Code 3) while the vehicle is occupied by passengers, except in the interest of protecting life such as taking an injured person to the hospital.
5. Officers operating a Police vehicle will obey all traffic laws and take extra care not to draw attention or discredit the department.
6. No officer while on-duty shall have anyone ride without expressed permission from the Chief of Police, Assistant Chief, Major, or Commanding Officer and a WAIVER SIGNED.
7. Whenever an Officer is involved in an accident off-duty he will immediately inform the radio dispatcher of the situation and have an accident report made. The report will be made by the Commanding Officer on duty at the time.
8. Police vehicles will not be used in any other type of EMPLOYMENT or DRIVEN TO & FROM SUCH EMPLOYMENT without the consent of the Chief of Police.
* So Chief Harl you are telling us taxpayers we have to pay the gas, insurance, tires and maintenance so our Police Officers can work a second job?
9. Except in the performance of duty, the vehicle will not be parked or left unattended on any parking lot in front of or NEAR TAVERNS or LIQUOR STORES or any other place which may cause discredit to the department.
10. No alcoholic beverages will be transported in the vehicle except in the performance of duty. Officers will not drive a vehicle when they have been drinking alcoholic beverages or they expect to do so.
B. Maintenance and care of Department Vehicles:
1. The officer assigned a vehicle will be responsible to see that the proper maintenance is maintained.
2. Schedule any work to be done with the city garage. No one without authority of the Chief of Police, Assistant Chief, or Major Will be allowed to work on police vehicles.
3. Officers will keep maintenance records and turn in a monthly report to the Major.
4. No equipment will be installed or carried in the vehicle without authority of the Chief of Police, Assistant Chief, or Major.
5. No animals will be transported in the vehicle unless the unit is designated as an official K-9 unit.
6. The officer assigned the vehicle will be responsible to keep it clean inside & out as often as possible.
C. Personal Appearance
1. Full Uniform
a. At no time will only part of the uniform be worn. When an officer operates his vehicle off-duty in uniform, he/she shall be in full uniform, of the season, the same as if he was on-duty.
2. Civilian Dress
a. When operating a police vehicle off-duty officers civilian dress will be neat & clean. Sport clothes will be allowed, but the main trunk of the body shall be clothed.
D. Police Activities
1. When an occasion arises that an officer must become involved in a police activity off-duty, he shall notify the radio dispatcher immediately, giving his unit number, location, and all pertinent information, and take whatever action necessary to resolve the situation.
2. When an occasion arises that an Officer must become involved in a police activity off-duty and has his family or other passengers in the vehicle he will take whatever steps necessary to insure their full and complete safety.
3. The officers involved in this program will make necessary reports of incidents that he handles off-duty. In cases of a serious nature standby until the on-duty officer arrives and he will be responsible to make the reports.
4. A LOG BOOK will be keep in each unit and a monthly activity report turned into the Major.

Neal, who earned her law degree from the Indiana School of Law-Indianapolis, worked for nearly six years in the Office of the Indiana Secretary of State. She first served as director of business services and general counsel for former Secretary of State Sue Anne Gilroy and then, from 2003-2005, as chief of staff for Secretary of State Todd Rokita. NEW ALBANY STREET DEPARTMENT BUDGET PARED!
"The Street Department-which cleans, repairs and maintains New Albany's 150 miles of roads-was not so fortunate. The council voted no relief to the department at Thursday night's special meeting and City Controller Kay Garry did not suggest any."
And...
Garry states: a recent cash infusion from economic-development tax revenue that was meant to wipe out the Street Department's deficit and pay for a sweeper and yard-waste collection truck the department wants and would cost about $250,000 combined.
The council upheld the state's order of a $347,357 cut to a $1,322,229 budget for 2007, a calculation based on the gas-tax revenue that funds the Street Department.

Freedom of Speech would like to ask: Why did the Council agree to cover the 2007 Budget Cuts for Board of Works and Controller's Office, and ignore the $347,357 budget cut in the Street Department?
The previous approval of $800,000 EDIT money was made to cover a deficit in the Street Department. The Street Department should NOT be blamed for that deficit.
For your information Mrs. Garry, the Sanitation Department was privatized and some sanitation staff was moved over to the Street Department. Our Street Department picks up waste that the new "Private Sanitation Company" does not pick up!
So--the Street Department needs funding to pay extra staff and they need funding for repairs and new equipment.
Sure makes sense to us taxpayers!
Does it seem like a fair decision Mrs. Garry when:
1.) you dumb more work on them and then,
2.) cut their budget?
Why don't we just cut the Controllers budget!
Freedom of Speech has a suggestion: "Council needs to review this problem."
Also Mrs. Garry, you are paid by us citizens to look out for taxpayers best interest. To spend our money wisely. What ever happen to creative funding?
You always seem to have money for everything else this administration wants.

TAXPAYERS VS POLICE POLICY
We think the Council needs to look at all MANDATED services and begin cutting those that are not required by law or ordinance. Our city continues to throw our hard earned tax dollars towards perks for city police officers; yet the infrastructure is falling apart.
Yet with all the tough issues facing our council and taxpayers, police officers still find time to climb atop their respective soapboxes and start flailing away at the three New Albany City Council members scrutinize use of city vehicles!

Back in August 18, 2004 Councilman Larry Kochert said the council will discuss the take home car policy and the city can save money in that area. "The whole thing needs to be looked at," Kochert stated. "We've got to look at cost-cutting."
City Councilman Jack Messer, who is also a NAPD officer, said he is not against the take-home program, but agrees with Kochert that those who live outside the city should not take the cars home.

No records were maintained by any of the employees of the personal mileage driven and the taxable fringe benefit was not reported on their W-2.

We have watched with interest this discussion about NAPD take home cars for over 2 1/2 years. It is time our council steps up to the plate and imposes fees on those officers who use the take-home cars while off-duty. We are sick and tired of the comments: The city has been doing this for 30 years, and now 20 years!
Could this be why our city is in the mess were in?
Nothing upsets citizens more than someone driving a police car with their family in it. But for taxpayers to pay their gas bill, is wrong. We understand our officers put their lives on the line every day.
Freedom of Speech would like to know why 3 police cars continue to be parked half the night down by the K&I Bridge? Can't you guys afford a hotel room?
And if anyone thinks a police car in the vicinity of where someone is about to commit a crime deters them, you are crazy. We know that's used as an argument for them to drive their police cars home, but that theory doesn't hold water either.
However if you take home your handheld radio, you could radio an uniformed officer on duty to make an arrest instead of putting officers, friends and family in danger.
Chief Harl can not convince us, there is no benefit to city taxpayers, and the cost to the taxpayers is far less defensible, when the vehicles are driven outside city limits. One must ask if it is fair for city taxpayers to pay to have police cars commute daily to and from Harrison County, Clark County, and Washington County. The NAPD has about 65 officers, and about 28 actually live in the city limits!
Freedom of Speech also has a problem with officers using their patrol cars for off duty jobs that they are paid for, but where the city is not compensated. The city would, however, be responsible if something happened to a take-home car.
You police officers say, there is no place to park your fleet of police cars. Well for our argument the solution is we have an half empty parking garage that can handle this very issue.
So unload your gear, because it's time you either park them cars or pay for your own damn gas!
Capt. Bailey you make $44,841.26 a year, can't you afford to buy your own gas?

The NAPD has about 65 officers, and about 28 actually live in the city limits!
Freedom of Speech also has a problem with officers using their patrol cars for off duty jobs that they are paid for, but where the city is not compensated. The city would, however, be responsible if something happened to a take-home car.
You police officers say, there is no place to park your fleet of police cars. Well for our argument the solution is we have an half empty parking garage that can handle this very issue.
So unload your gear, because it's time you either park them cars or pay for your own damn gas!
Capt. Bailey you make $44,841.26 a year, can't you afford to buy your own gas?

That our mayor prior to the may election was all for the NAFD's new contract including a raise, fixing the ambulance problems, and fixing many of the other contractual issues that raised concerns.
But...
After Jimmy was beat he would no longer sign off on anything, as a result of his animosity towards our firefighters. This administration is now going to have to waste valuable city tax dollars, as well as union money in order to go to arbitration to get the situation resolved.
So much for bargaining in good faith Jimmy!

Here's some background information that might be helpful to your readers.
Storm water is a major source of water quality problems in urban areas, such as New Albany. Urban areas have a higher percentage of impervious surfaces such as sidewalks, rooftops and parking than rural areas or forested areas.
When it rains, storm water runoffs carries polluntants from these surfaces to the municpal seperate storm sewer system (MS4) and they flow directly to local waterways without any treatment. In contrast, your sanitary wastewater flows to a wastewater treatment plant where the pollutants are removed before being discharged to local waterways.
New Albany owns or operates a MS4. Federal regulations require MS4s designated by the permitting authority to apply for and obtain National Pollutant Discharge Eliminations Systems (NPDES) permits for their storm water discharges.
The Indiana Department of Environmental Management (IDEM) is the permit issuing authority in Indiana. The requirements that New Albany must follow are found in IDEM's rule entitled "Storm Water Runoff Associated with Municipal Separate Storm Sewer Conveyances" (Rule13). In short, Rule 13 requires New Albany to develop a storm water management plan that address:

Many municipalities develop storm water fees to fund their storm water programs. I looked at the New Albany Storm Water Board Website and they have also assessed a storm water fee.
This type of funding mechanism is becoming the choice of many municipalities that are required to apply for storm water permits.
The fee is based on the amount of impervious surface area per property. Homeowners pay lower fees than commercial and industrial sites. It is a fair way to fund the storm water program because all sites contribute to the runoff problem.
Remember the goal is to keep pollutants out of local waterways so the citizens of New Albany can enjoy them.

We also agree with your treasurer Mrs. Garry when she stated, she prefers a City Fund not a Utility!
We understand it is the responsibility of the City Plan Commission, Redevelopment Commission, and County Plan Commission to stay up on EPA mandates for redevelopment projects being done in the City and County.

FLOYD COUNTY BLOOD DRIVE IN HONOR OF POLICE OFFICERS
Freedom of Speech is pleased our local Sheriff's Department has requested...for us to announce the following information:
Community Rallies to Show Support of Fallen Officers
In response to calls from the community to show support for the police officers shot monday night in Floyd County. the community blood drive scheduled for Thursday, June 21, will be in honor of Deputy Frank Denzinger and Deputy Joel White.
The blood drive will be on thursday, June 21, at Wesley Chapel United Methodist Church from 12 noon until 8 p.m. Wesley Chapel United Methodist Church is located at 2212 State Street in New Albany.
If you are at least 17 years of age, weigh a minimum of 110 pounds and are in good general health, you may be eligible to donate blood.
In addition to blood donations, participants will have the opportunity to sign cards for the families of Deputies Denzinger and White.

January 11, 2007 you state the board can confidently say that with the guidance of our treasurer and city controller Kay Garry, we are on solid financial ground and will continue to manage your stormwater fees wisely.

On April 13, 2007 Kay Garry your Treasurer stated: There are 2 ordinances (G-0509 & G-0620) regarding Storm Water/Drainage that are contrary to each other. The ordinance will have to be "amended by the City Council" (which has not been done yet) to be a Utility or a City Fund. Your treasurer states and we quote: Mrs. Garry prefers a City Fund not a Utility!

Your budget of $1,409,507.68 is an insult to New Albany taxpayers, some taxpayer's are over billed, under billed, and not billed at all. How can you spend taxpayers monies when you have been operating for about a year without a budget or the council approval on any type of appropriation?
Maybe you need to check with your sister, who is an attorney to see if you are now liable to us the taxpayers?

Will the controller and the mayor make their decisions on the 2007 Budget, and the Council won't even know what is going on?

And will these cuts affect our City Services?

Carl Malysz was introduced today as the new Economic Development Director to fill Wheatley's position.
"Garner said he was considering whether to replace Wheatley for the final seven months of his term or push for the council to "fully fund" One Southern Indiana."

Wake up New Albany, your lives may be in danger. Our New Albany Fire Department is in such turmoil because of poor management.
Our New Albany firefighters are being harassed, intimidate and they are refusing to discuss the current state of our NAFD. The current management of our Fire Department is setting our city up for future lawsuits.

A new wrinkle in the saga of firefighter employment has prompted New Albany's executive and legislative bodies to trade accusations of illegal activity.
On Tuesday, the Board of Public Works and Safety enacted a firefighter-hiring procedure, effectively trumping a City Council that Mayor James Garner said has been "making a mockery of the democratic process" ...
But...we have the real story!
Because of the executive board and the EMT's raising such awareness when Squad 10 was taken off track is when all this started. The New Albany Fire Chief is holding EMT's basically hostage on the ambulance stating, "that ambulance personal should have not taken the course and if they don't want to be on the ambulance to give up their numbers? This way the Chief can get rid of the ambulance stating he does not have the individuals to work it.
What the taxpayers of New Albany doesn't know, all 11 of the EMT'S assigned to the ambulance volunteered to take the class on their own, to better the service for the fire department and to better serve the citizens of New Albany.
And with the size of our city, the citizens of New Albany deserves an ambulance service of this caliber, regardless of what the Garner administration and Chief's office thinks.
The individuals working the ambulances along with the executive board are trying to fix the problem, but the Chief and the Mayor refuse to do anything about it because they want to get rid of the ambulances all together.
The Chiefs office called the EMT's whiners and punished all personnel who holds the EMT certification by placing them on the ambulances regardless if they were 5 year veteran or a twenty year veteran.
All anyone on the ambulance is asking is that all new recruits have to become EMT certified, this will enable the Fire Department EMS Service to thrive and grow.
The current contract states all new recruits must become BLS and all the union is asking that all new recruits become EMT's.
Really not that complicated is it?
Especially, when the class can be taught for free by individuals on the fire department.
Freedom of Speech would like to ask:
Why in the last 3 1/2 years not one grievance has been passed by Fire Chief Ron Toran, or his son Tony Toran President of The Board of Works against the Fire Department. And why not? How fair is this set up? Does the words Conflict of Interest apply? Or is Tony just covering his dad's legal ass?
Furthermore, the Chief's office refuses to promote any ambulance personnel assigned to ambulances. Why?
Chief Toran where is the Accountability System that was granted by Homeland Security? This equipment was obtained by grant, which is used to save fire fighters lives. It has yet to be put into use and we want to know why?
The state of the fire department has been in the gutter for nearly 16 years now thanks to poor management. The people on the department are accustomed to turmoil, friction and unnecessary BS.
It did not take citizen's advocate Valla Ann Bolovschak long to figure out what is being done to our firefighters is illegal, immoral, and opening the city up for potential lawsuits. After weeks of research and verifying the ordinances and several calls to Indianapolis, she knows that if an ordinance is established it precedes all other ordinances thus nullifying the 2003, 2004 hiring list which is part of what is being used to select our new 12 recruits.
It's time the council takes action, don't let them do whatever they want. It's sickening and sad how this community operates. It's equally sickening and sad how the Council, Board of Works and any others in a positions who could take action just sit and watch because they don't have the guts to do something about it, or at least try.
Shame on you...All of you!
Plus, there is a union President, Dick Duggins, who is trying to get his son hired so he isn't going to try and stop them. We ask why piss off the people who could give your son a future? What kind of a future will he have on the NAFD if things continue to be managed the same old New Albany Good Ole Boy ways?
There are grievances stacked waiting to go to arbitration (which the membership has already voted and approved to do so) but are seeing no action by this President for some reason. Hmmm. Wonder why?
His course of action seems to be working.
We did verify his son did get an interview. Can't call him stupid...just irresponsible and untrustworthy in a leadership role. And wait, there's more...Duggins is apparently running around telling everyone that HE is going to be the next Fire Chief...Ain't gonna happen Dick!
It's going to take alot of work by someone who actually knows how to manage people, to bring those folks around and make the NAFD what it really should and can be. These are good people.
It's the management that is beyond highly questionable!
The fact that the mayor can stand before the city and everyone else and say Ron Toran is the best man for the chief's job and the best chief the department has ever had is ludicrous, absolutely ludicrous.
That is just wrong and totally misleading. If our mayor truly believes that then I would highly question his ability to make good decisions...Oh, wait...it all makes sense now.
It all boils down to irresponsibility and sheer ignorance...Literally.
Where is the checks and balances of this city?
Unfortunately it looks like the fire department is not going to be getting the top recruits like the ordinance dictates and the city will be getting "sued once again" by those individuals who are more qualified for these 12 positions.
Freedom of Speech selected these 3 New Albany Officials because of:
* Illegal hiring practices, that opens the door for future lawsuits
* Wasteful spending of taxpayers dollars, this department will require additional appropriation to cover additional over-time which is about $1 million dollars by the end of 2007.
Freedom of Speeches Fleecing award goes to:
Mayor~Jimmy, Fire Chief~Ron Toran and (Kroger Boy) ~Tony Toran.
The good news is that the Fire Department has been around since 1872 and will continue to thrive regardless of the Mayor, Board of Works and the Chief's adminstration seeks to do!

From what we have verified this is going on, and it's illegal. There are people who got interviews who were not on the current hiring list. They themselves were confused because they had given up, thinking they were never going to be called because a new test had been administered.
